OK. 29th December 2002, Tom is in an minor RTA (Road Traffic Accident) with his electric scooter. He blames me, I blame him, and I'm not hearing the end of this, and neither is anybody that Tom meets. So we thought we'd throw it out to you, the jury and let you decide, and no votes of sympathy for the sick kid LOL

Just to set the scene, it's approaching Toms 1 year celebration since transplant on Jan 8th 2003, he really wanted a new electric scooter, the type you sit down on. On the way back from the hospital, we have to detour around the interstate due to traffic, and there it was in the middle of nowhere, a little motorcycle shop with electric scooters outside, we stop, choose a color and the rest is history.

Marks Account:
"I swear to tell the truth the whole truth yadda...yadda..yadda...We take out the scooter for a spin just at the front of the house, I use Toms old stand up type electric scooter, his new one just blows me away, considerably faster. Before getting on I admit he did suggest that he should put all his elbow and knee pads on, and I have to say I did say you'll be ok for a minute, I'm normally really keen on things like that, and can't excuse myself on that one, he did have his helmet on that's a must at all times. We played around had fun. Later that night he suggested we have a drive over to North Bay (sub division next to us where we used to live), he has indicators, light, horn, the whole deal, very slick, so off we go, had a lot of fun for sure, everthing went well.. On the way back Tom is behind me whilst I plod along, I decide to sit down on the scooter, just for fun, I watch too much Jackass, naturally I'm a little unstable and I do my best to keep straight.

I keep looking behind us to make sure a car is not coming, which was difficult as Tom has a bright light built into his scooter, when I look, I drift a little. Suddenly Tom, AKA Michael Schumacher decides he'll pass me, his scooter doesn't have any problem making a reasonably quick pass, however as I look over my shoulder to see what he's doing, I drift a little and I mean a little to the left, he panics as we did get real close, steers away from me too quickly, and loses balance, next second his scooter is scraping across the ground and he's going with it. He says I drove into him, I didn't make any contact, and I didn't drift very far, when he overtook he left no room he was way to close to me, all I had to do was drift a little bit and we were on a collision course. That's my story...and I'm sticking to it..Why the heck we went out on the thing when Tom had just become neutropenic (no protection against illness as his white cells are playing around) I have no idea, possibly temporary insanity."

Toms Account (As dictated by Tom himself)
"Firstly, don't believe everything you read! I insisted that I put on my knee and elbow pads because I might get hurt, but NOOOOO! not Mark, he said I'd be OK! (Retard).

So here's the facts. We were fine going up and down the street outside our house, but we then decided to go to North Bay for a longer ride. Half way there we turned round and headed back home. I was riding perfectly well and was very stable. A couple corners away from our house I decided to overtake my dad because he was doing this really stupid sit down thing and was going really slow. He says I was inches from him, but I was really about 3 feet away and I'm not exagerating. But when I started overtaking him he decided to do some 'road-rage' and turned into me. Then I panicked and turned away from him really fast and fell off. We didn't touch. But it was his fault. My jacket caught on the throttle and dragged me like 6ft on the ground. Then he was trying to get me out of the road when I couldn't move because I was in so much pain I thought I'd broke my arm and leg. That's the end of my facts!"
